Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Luminamist website, apps, digital books, and related services (collectively, the “Service”) operated by Luminamist (“we,” “us,” or “our”).

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

Luminamist offers illustrated picture books and bedtime reading experiences for families with young children. Depending on availability, the Service may include digital reading, audio or read-aloud features, physical book offerings, curated collections, and family account tools.

We may add, change, or remove features over time. Some content or features may be available only in certain regions or as part of a paid subscription.

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, purchase a subscription, or enter into a binding contract with us.

Children may use Luminamist only with the involvement and supervision of a parent or legal guardian. By allowing a child to use the Service under your account, you represent that you have authority to do so and accept these Terms on the child’s behalf.

Some features require a registered account. You agree to provide accurate information, keep your login credentials secure, and notify us promptly of any unauthorized use of your account.

If we offer a free trial, the trial length, eligible features, and conversion to a paid plan will be described at sign-up. Unless otherwise stated, a free trial may convert to a paid subscription at the end of the trial period unless you cancel before renewal.

You are responsible for all activity that occurs under your account.

Paid plans, prices, billing intervals, and taxes will be shown at checkout or in your account settings before you are charged. By subscribing, you authorize us and our payment processors to charge your selected payment method on a recurring basis until you cancel.

Subscriptions renew automatically unless canceled in accordance with the instructions provided at purchase or in your account. Refunds, if any, will be handled according to the policy displayed at checkout or required by applicable law.

We may change subscription prices or plan features with reasonable advance notice where required. Continued use after a price change takes effect may constitute acceptance of the new price.

The Service, including text, illustrations, audio, software, branding, and design, is owned by Luminamist or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms and your active subscription or purchase, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content for private, non-commercial family reading. You may not copy, distribute, publicly perform, modify, reverse engineer, or create derivative works from the Service or its content except as expressly permitted by us in writing.

You agree not to misuse the Service. Without limiting the foregoing, you may not:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to accounts, systems, or data.
• Scrape, crawl, or harvest content or user data except as permitted by us.
• Interfere with or disrupt the Service, including by introducing malware or excessive automated requests.
• Harass, abuse, or harm others, or upload content that is defamatory, obscene, or infringing.
• Circumvent access controls, digital rights management, or subscription requirements.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Luminamist content is intended for entertainment and family reading. It is not medical, psychological, educational, or parenting advice, and it does not replace professional guidance.

To the fullest extent permitted by law, Luminamist and its officers, directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.

Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) fifty U.S. dollars (USD $50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You may stop using the Service at any time. You may also cancel a subscription through your account settings or the method provided at purchase.

We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, created risk or possible legal exposure for us, or if we discontinue the Service. Upon termination, your right to use the Service ends immediately, but sections that by their nature should survive will remain in effect.

Our handling of personal information after termination is described in our Privacy Policy.

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence provide otherwise.

Except where prohibited by applicable law, you agree that disputes arising out of or relating to these Terms or the Service will be brought in the state or federal courts located in Delaware, and you consent to their jurisdiction.

We may modify these Terms from time to time. When we make material changes, we will post the updated Terms on this page and revise the “Last updated” date above. For registered users, we may also provide additional notice such as an email or in-product message.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, subject to applicable law.
